Mental capacity




Mental capacity is the ability to make decisions. This section describes how to assess capacity and how to protect the rights of people who lack it and is based on The Mental Capacity Act 2005, which applies to England and Wales only. The Act focuses on decisions about health, social welfare and finances, but its principles can be applied to any decision.





The five principles of capacity


The Mental Capacity Act describes five principles that should guide all work in this area – these are summarised in Figure 2. If you don’t apply these principles to the assessment of capacity and to decisions concerning people who lack capacity in England and Wales, then you will be breaching people’s statutory rights.
